Terms and Conditions

Effective Date: April 29, 2025

Welcome to Swipe Eats (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our mobile application and services (collectively, the “App”), which provides users with access to recipe content, food media, and social networking features.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility
You must be at least 13 years of age to use Swipe Eats. If you are under 18, you must have permission from a parent or legal guardian to use the App.

2. User Accounts
To access certain features, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials secure.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Content
a. User-Generated Content
You may upload, post, or share recipes, images, videos, and comments (“User Content”). You retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and promote your User Content in connection with the App.

You are solely responsible for your User Content and agree not to post anything:
- Infringing on intellectual property rights,
- Offensive, defamatory, or obscene,
- Misleading or false,
- Containing unauthorized promotional materials or spam,
- Which includes music that is copyrighted cannot be used outside of paid use.

We reserve the right to remove content that violates these guidelines.

b. Swipe Eats Content
All content provided by Swipe Eats, including recipes, graphics, branding, and layout, is protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

4. Community Guidelines
Users agree to engage respectfully and refrain from:
- Harassment, bullying, or hate speech,
- Posting harmful or dangerous content,
- Impersonating others,
- Violating the privacy of others.

We reserve the right to suspend users who do not comply with these rules.

5. Data Collection and Usage
We collect limited information related to how users interact with the Application. This information is used exclusively for internal analytics purposes, including improving performance, stability, feature development, and overall user experience. We do not use collected data for advertising, marketing profiling, or cross-application tracking.

a. Information We Collect
We collect analytics data related to application usage, which may include:
- Device type, operating system, and application version
- Anonymous or pseudonymous device identifiers
- Application interaction events (e.g., screen views, feature usage, button taps)
- Session duration and performance metrics
- Error logs and crash reports

If users create an account or log in to the Application, we may associate analytics events with a pseudonymous internal user identifier. This allows us to understand how features are used across sessions and devices to improve product functionality.

When analytics events are associated with a user identifier:
- The identifier is an internal application ID and is not publicly visible.
- We do not use this identifier for advertising or cross-application tracking.
- We do not sell or rent this information.

We may also associate limited user profile properties with analytics data, such as account creation date, subscription status, or general usage classifications, strictly for internal product improvement and operational purposes.

We do not intentionally collect sensitive personal information such as:
- Government identification numbers
- Financial account information
- Health data
- Biometric data

We do not collect precise location data for analytics purposes.

b. Purpose of Data Collection
We process analytics data solely for the following purposes:
- Monitoring and improving application performance
- Diagnosing technical issues and resolving bugs
- Understanding feature usage to inform product development
- Enhancing user experience

We do not sell, rent, or trade analytics data. We do not use analytics data for behavioral advertising.

c. Analytics Service Provider
We use a third-party analytics service provider to process analytics data on our behalf. The provider processes data solely for internal analytics and product improvement purposes and does not use the data for independent marketing purposes.

d. Data Sharing
We do not share analytics data with third parties except:
- With our analytics service provider solely for processing on our behalf
- When required by law
- To protect the rights, safety, or security of users or the Application

We do not sell personal information.

e. Data Retention
Analytics data is retained only for as long as necessary to fulfill the purposes described in this section, unless a longer retention period is required by law.

We may configure automated retention limits to ensure data is not stored indefinitely.

f. User Rights and Data Deletion
Users may request access to or deletion of their associated analytics data by contacting us at: support@swipe-eats.com
Upon verification of identity, we will process deletion requests within applicable legal timeframes.

g. Opt-Out
Users may opt out of analytics collection by:
- Disabling analytics in the Application settings (if available),
- Contact us directly using the information above.

6. Third-Party Links
Swipe Eats may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party services and you access them at your own risk.

7. Disclaimers
The App is provided “as is” without warranties of any kind. We do not guarantee:
- Accuracy or reliability of any content,
- That the App will be uninterrupted or error-free,
- That recipes or dishes are safe, allergen-free, or nutritionally accurate.

Use your own judgment and consult a professional where appropriate.

8. Limitation of Liability
To the fullest extent permitted by law, Swipe Eats and its affiliates will not be liable for:
- Indirect, incidental, or consequential damages,
- Loss of data, revenue, or goodwill,
- Any unauthorized access or use of your account or content.

9. Termination
We may suspend or terminate your access to the App at our sole discretion for any reason, including violation of these Terms. You may also delete your account at any time through the App settings.

10. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes, and your continued use of the App after such updates constitutes your acceptance of the new Terms.

11. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Utah, without regard to conflict of laws principles.

12. Non-Disclosure Agreement
You agree not to disclose or use any confidential or proprietary information obtained through your use of our services for any purpose outside the scope of these Terms, unless required by law.
